These Terms of Use govern access to ASRE-controlled websites, forms, and online services that link to these Terms, including the ASRE — Seller Inquiry form. By using those services, you agree to these Terms and acknowledge the ASRE Privacy Policy.
If you do not agree, do not use the online service. Separate written agreements control any brokerage representation, listing, referral, property-management, construction, consulting, or transaction service.
Submitting an online inquiry is a request for information or contact. It does not by itself:
create a broker-client, agent-client, fiduciary, representation, listing, referral, property-management, contractor, consultant, partnership, joint-venture, or attorney-client relationship;
obligate ASRE to accept an engagement, list or purchase a property, produce an offer, provide a valuation, arrange financing, or complete a transaction;
authorize ASRE to sign, accept, reject, negotiate, or execute a contract for you;
establish that a property is available, marketable, financeable, insurable, code-compliant, or suitable for any use; or
authorize a payment, charge, contract execution, marketing campaign, or automated communication.
Any professional relationship or transaction must be established through the separate disclosures and signed agreement required for that service and jurisdiction.
You agree to provide information that is accurate to the best of your knowledge and not intentionally misleading. You represent that you are authorized to provide the contact and property information submitted.
Do not submit another person’s private information without authority. Do not submit Social Security numbers, account credentials, payment-card information, government identification numbers, medical information, or other unnecessary sensitive information through a general inquiry form.
ASRE may review suspected duplicate, incomplete, false, abusive, or unauthorized submissions. ASRE is not required to automatically merge records or accept a claimed identity, ownership interest, or authority without verification.
Website content, automated estimates, market statistics, property descriptions, calculators, suggested price ranges, repair observations, and preliminary seller-option discussions are general information only unless a signed agreement states otherwise.
They are not an appraisal, inspection, title opinion, survey, engineering report, environmental report, legal advice, tax advice, financial advice, loan commitment, insurance decision, contractor proposal, or guarantee of price or outcome. Conditions and market information can change, and third-party data may be incomplete or inaccurate. Obtain the appropriate independent professional advice before making a decision.
ASRE separates the service request from optional permission to use particular communication channels.
ASRE may respond manually to the inquiry using contact information and permissions you provide or as otherwise allowed by law.
Optional permission for calls, email, text messages, or marketing must be presented and recorded separately where required.
Consent to receive marketing communications is not a condition of obtaining brokerage information or services.
Message frequency may vary and message or data rates may apply.
You may withdraw permission using any reasonable method, including replying STOP to a text, using an unsubscribe link in a marketing email, emailing ASRE, or calling ASRE.
Revoking a communication permission does not invalidate lawful communications made before the revocation and does not prevent communications that are legally required or otherwise permitted without that consent.
The initial ASRE-LIVE-01 seller-intake release sends internal alerts only. It does not automatically send client email, text messages, calls, voicemails, or appointment messages.
ASRE supports equal housing opportunity. ASRE does not intend to discriminate in the availability or provision of real estate-related services on any basis prohibited by applicable federal, state, or local law.
Users may not use an ASRE service to submit discriminatory requests, preferences, instructions, or content. ASRE may decline or remove content or activity that appears unlawful, discriminatory, fraudulent, threatening, abusive, or unsafe.
You may use the online services only for lawful personal or business purposes connected to a legitimate real estate inquiry. You may not:
interfere with the website, form, security, or another user;
submit malware, automated spam, excessive requests, or false identities;
scrape, copy, republish, sell, or exploit content or data except as permitted in writing or by law;
attempt to obtain unauthorized access to accounts, systems, records, or personal information;
impersonate ASRE, its personnel, or another person; or
use the service to violate intellectual-property, privacy, fair-housing, consumer-protection, telemarketing, or other law.
ASRE may restrict access or disregard a submission when reasonably necessary to protect users, systems, records, or legal rights.
Unless otherwise stated, ASRE or its licensors own the ASRE website content, branding, design, text, graphics, and other protected material. Limited access to the website does not transfer ownership or grant a license to reproduce, distribute, modify, sell, or create derivative works from protected material.
Third-party names, listing information, trademarks, data, and content remain subject to their owners’ rights and any applicable data-license restrictions.
ASRE may use or link to third-party services such as hosting, customer-relationship management, mapping, communications, listing, lender, settlement, inspection, contractor, or government services. A link or technical connection does not mean ASRE controls or guarantees the third party. The third party’s own terms and privacy practices may apply.
ASRE may correct, update, suspend, or discontinue online content or functions. We do not guarantee that a website or form will always be available, error-free, secure, or compatible with every device. ASRE may correct obvious errors and may request verification before relying on submitted information.
To the maximum extent permitted by law, the online services and general information are provided on an “as is” and “as available” basis. ASRE disclaims warranties not expressly stated in a signed agreement, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and accuracy.
Nothing in these Terms limits a duty or warranty that cannot lawfully be excluded.
To the maximum extent permitted by law, ASRE will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of, inability to use, or reliance on general website content or an inquiry form.
This limitation does not exclude liability that cannot lawfully be limited, does not replace the terms of a signed professional-services agreement, and does not waive consumer rights that applicable law makes nonwaivable.
The ASRE Privacy Policy describes the collection, use, disclosure, retention, and protection of personal information. If these Terms conflict with a privacy right that cannot lawfully be waived, the applicable privacy law controls.
Except where another law must apply, these Terms are governed by Maryland law, without regard to conflict-of-law principles. Any court proceeding concerning only these website Terms should be brought in a court with lawful jurisdiction in Prince George’s County, Maryland, unless applicable consumer or other law requires a different forum.
Nothing in this section changes the governing law, jurisdiction, dispute procedure, or professional obligations established by a later signed agreement.
ASRE may update these Terms when its services or legal obligations change. The posted version will show its effective date. Continued use after the new version becomes effective constitutes acceptance to the extent permitted by law. A material change will not retroactively alter a signed agreement or waive a right that applicable law protects.
